LIFETIME WARRANTY

SPARKLE  Computer Corp. (hereinafter mentioned as Sparkle) is committed to creating high-performance products for gamers and PC enthusiasts, and has delivered some of the most recognized and respected graphics card designs in the world over the past 25 years. It is the company’s never-ending pursuit of excellence and dedication to quality, in everything from product design and manufacturing to post-sales customer service that sets SPARKLE apart. In continuation of its efforts, SPARKLE is pleased to announce a Lifetime Warranty for all SPARKLE Graphics Cards.

LIFETIME WARRANTY

SPARKLE (“SPARKLE”) warrants the product, to be free from defects in materials and workmanship for the life of the product as sold to the original purchaser (“PURCHASER”), subject to all the terms and conditions hereunder. This warranty is for replacement for like items only. Lifetime replacement warranty does not cover items out of production if the company no longer stocks them. (Lifetime is defined as the lifetime of the product on the market. Outdated technology is not covered by lifetime warranty if the item is no longer available on the common market as a new product.) This warranty is not assignable. Third party products, such as motherboards and other system components using or interacting with the SPARKLE products are not covered by this warranty.

SPARKLE’s sole obligation under this warranty is to replace or, at its option, to repair, free of charge, all the product’s defective parts. This warranty applies only on the condition that the product has been installed, maintained, and operated under conditions of normal use and in accordance with the installation guide provided herewith. The provisions of this warranty shall not apply if, in SPARKLE’s sole judgment, the product has been subject to misuse or neglect, improper installation, damaged in an accident, or repaired or altered in any way that affects its performance or reliability.

SPARKLE will honor the Lifetime Warranty all SPARKLE graphics card products purchased on or after September 1, 2009 in the United States, provided that the above conditions as well as the following conditions are met:

  1. All SPARKLE graphics card products MUST be registered within thirty (30) days of original date of purchase in order to receive the Lifetime Warranty. (All products NOT registered within 30 days shall receive the Standard Warranty.)
  2. All SPARKLE graphics card products under warranty coverage MUST be accompanied by proof of purchase documentation evidencing the date of purchase (copy of original invoice/receipt). (All products NOT accompanied by copy of original invoice/receipt will be returned to PURCHASER at PURCHASER’s expense.)
  3. All SPARKLE graphics card products requiring warranty services (repair or replacement) MUST be returned to SPARKLE with properpackaging. (All products NOT properly packagedwill be returned to PURCHASER at PURCHASER’s expense.)


Warranty coverage on SPARKLE graphics card products shall be VOID under the following conditions:

  1. The SPARKLE graphics card product shows evidence of the serial/part number sticker(s) being altered, removed, replaced, or defaced.

    The SPARKLE graphics card product had been damaged while being installed. 
  2. The SPARKLE graphics card product had been damaged by software/hardware from a company or individual other than SPARKLE or by motherboard incompatibility.

  3. The SPARKLE graphics card had not been operated in accordance with SPARKLE specifications, instructions, or any technical support directions.

  4. The SPARKLE graphics card had been modified or damaged by overclocking, tampering, user error, accident, disaster, abuse, misuse, power supply, power application, alteration, repair, modification, a fix/replacement by a company or individual other than SPARKLE.


The following provisions apply to all SPARKLE products sent in for Return Merchandise Authorization (“RMA”) in connection with a warranty claim:

  1. PURCHASER shall pay for all costs associated with shipping the product to SPARKLE. If shipped from outside the United States, this will include freight, duty, customs fees, and taxes. SPARKLE shall not be responsible for any fees charged due to brokerage fees.

  2. PURCHASER shall assume the risk of loss (insurance from loss or damage) in transit and the returned products shall become the sole property of SPARKLE. SPARKLE warrants that the repaired or replaced products will be free from defects in material or workmanship.

  3. SPARKLE shall reserve the right to inspect and verify the defectiveness of any product returned. Please shall allow 48 hours as processing time once product has been received by SPARKLE, and 3-5 business days for shipping of the repaired or replacement product (shipped ground to the U.S.).

This warranty is in lieu of any other warranties, either express or implied, including without limitation any warranties of merchantability or fitness for a particular purpose or title against infringement, which other warranties are expressly excluded and disclaimed. SPARKLE shall not be liable for loss of profits or any special, incidental, EXEMPLARY, consequential, or punitive damages which purchaser or third party may sustain, even if SPARKLE has been advised of the possibility of such losses or damages. In no event shall SPARKLE’S liability exceed the purchase price of the defective product.

PURCHASER acknowledges that the goods sold by SPARKLE are being used or incorporated into other products or systems, and the ultimate safety of those products or systems are the sole responsibility of PURCHASER. PURCHASER assumes all risks and liability for use of SPARKLE products in other products or systems. In addition, SPARKLE is not responsible for any archival, backup, or disaster recovery services. In no event shall SPARKLE be liable for any damages of any kind sustained by PURCHASER, any customer of PURCHASER, and patient, or others for any suit or claim or demand arising from or related to the exercise of professional judgment and skill, or data entered into or used with the SPARKLE products.

Some states do not allow the exclusion or limitation of incidental or consequential damages so these limitations may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from state to state.

 

This warranty shall not be extended, altered, or varied except by a written instrument duly signed by SPARKLE.
